3B Scientific Fights Unfair Competition and Wins (08-10-2007)
Atlanta, GA - August, 2007 - 3B Scientific has taken swift legal action to stop the flow of infringing products into the United States and end distribution of unauthorized promotional material containing many copyright infringements and false advertisements. This example of copyright infringement, unfair competition and false advertising came to the company’s attention during an exhibition in the USA in April, 2007.
In May, 2007, 3B Scientific obtained samples of suspected copies of 3B Scientific® models and suspected examples of false advertising from the company East Coast Scientific. 3B Scientific subsequently filed suit against East Coast Scientific for copyright infringement, unfair competition, and false advertising in the United States District Court for the Northern District of Georgia in Atlanta, Georgia. In July, 2007, the Court entered a consent judgment against East Coast Scientific on 3B Scientific’s claims. The consent judgment also included the following relief: • Permanent injunction enjoining East Coast Scientific from (1) using altered 3B Scientific® products and images to promote defendant’s products and services; (2) misrepresenting the origin of 3B Scientific® product; (3) reproducing, promoting, distributing and selling in any manner the infringing products that are the subject of the suit; and (4) reproducing, promoting, distributing and selling in any manner derivative works based on the infringing products that are the subject of the suit;• Requirement for East Coast Scientific to post an apology on its web site • Requirement for East Coast Scientific to notify all persons who received catalogs or promotional material containing infringing material • Payment of monetary damages to 3B Scientific and all court costs
